1. 1. Parties and subject

This agreement is between KEP YAZILIM ÇÖZÜMLERİ LTD. ŞTİ. (“KepHomes”, the “Platform”) and the individual or legal entity who registers with KepHomes (the “User”).

It governs access to the Platform, your account, the content you publish and the conditions under which you use the services offered.

2. 2. Registration and verification

  • You must be at least 18 years old to open an account.
  • Registration is completed by verifying a one-time code sent to your phone number. You confirm that the number belongs to you.
  • An account has a SINGLE role: property owner, tenant or service provider. A second role cannot be added to the same number; a different number is required.
  • You are responsible for the accuracy of the information you provide. Your city of registration cannot later be changed by you.
  • You are responsible for the security of your account and password. Notify us immediately if you become aware of unauthorised use.

3. 3. The Platform’s role — what it does and does not do

KepHomes is a listing and management platform. It is NOT a party to agreements between users.

  • Rent, utility bills, marketplace sales and service fees are NOT collected through the Platform. Those payments are made between the parties outside the Platform.
  • The only payment processed through the Platform is the User’s purchase of Credits from KepHomes.
  • The user who publishes a listing is responsible for the accuracy of its content, the condition of the property and their obligations to the other party.
  • The Platform does not act as an intermediary, guarantor or surety between users.

4. 4. Use of Credits

  • Paid actions on the Platform are performed using Credits. A Credit is a digital unit of use offered by KepHomes; it is not money and cannot be converted into cash.
  • Purchasing Credits constitutes advance payment for the relevant service. Purchase terms are set out in the Distance Sales Agreement and the Preliminary Information Form.
  • Credits spent on an action are deemed consumed once the action is completed. Refund conditions are set out in the Delivery and Returns Terms.
  • Your Credit balance and all movements are visible in the credit statement in your account.

5. 5. Listings and Ministry verification

Property listings are verified through the Electronic Listing Verification System (EİDS) of the Republic of Türkiye Ministry of Trade, under the Regulation on Real Estate Trade.

  • Identity verification via e-Devlet is required before a listing can be published.
  • Ministry records are used to verify that the property belongs to you or that you are authorised by its owner. A listing that is not verified is not published.
  • The province, district, neighbourhood, block and parcel details come from the Ministry and are displayed on the listing in a form the user cannot alter.
  • When your authorisation expires or is revoked by the owner, the listing is withdrawn.
  • Legal and criminal liability for a listing based on false declaration rests with the person who published it.

6. 6. Prohibited use

The following are strictly prohibited:

  • Using another person’s identity, phone number or property details.
  • Publishing false, misleading or non-existent property or service listings.
  • Posting content involving insult, hate speech, obscenity or criminal conduct.
  • Using the Platform for spam, fraud or unauthorised data collection.
  • Attempting to disrupt the Platform, circumvent its security measures or extract data in bulk by automated means.
  • Uploading content that infringes third-party intellectual property rights.

7. 7. Content moderation and sanctions

  • You are responsible for the lawfulness of the content you upload.
  • Content that breaches the rules may be removed following a report or on our own review.
  • In serious or repeated cases your account may be suspended or closed.
  • Removal of content for breaching the rules does not require a refund of the Credits spent. Where the cause is an error on our side, Credits are refunded.
  • You may contest such decisions through our support channels.

8. 8. Rights in your content

You retain the rights in the photographs and text you upload. You grant us a limited, royalty-free licence, lasting for as long as the content remains published, to host and display it and to use it in promoting your listing.

The licence ends when you remove your content, except for copies that may remain temporarily in technical backups.

9. 9. Closing your account

  • You may close your account at any time.
  • Records that must be retained under applicable law will continue to be kept for their statutory retention period.
  • Unused Credits in a closed account are handled under the Delivery and Returns Terms.
  • The Platform reserves the right to suspend or close accounts in the event of a breach of this agreement.

10. 10. Limitation of liability

The Platform is provided “as is” and we do not warrant uninterrupted operation. Temporary disruptions may occur due to maintenance, faults or outages at third-party services (payment institution, Ministry services, SMS provider).

The Platform is not liable for losses arising from the relationship between users. For direct losses caused by our own fault, our liability is limited to the amount you paid for the relevant transaction.

This limitation does not affect liability arising from our wilful misconduct or gross negligence, nor your rights under consumer legislation.

11. 11. Force majeure

Neither party is liable for non-performance caused by events beyond its control, such as natural disaster, fire, epidemic, war, cyber-attack, decisions of public authorities, or general failures of electricity or internet infrastructure.

If such an event lasts longer than thirty days, either party may terminate this agreement. In that case the value of unused Credits is refunded to the User.

12. 12. Notices

Notices to you are sent to the phone number and email address registered on your account, or delivered as in-app notifications. Keeping this information current is your responsibility.

You may send notices to KepHomes at info@keporganization.com or through the contact channels on the Platform.

13. 13. Assignment

You may not assign your rights and obligations under this agreement to third parties without the written consent of KepHomes.

KepHomes may assign this agreement in the event of a merger, demerger or transfer of the business. You will be notified in advance and retain the right to terminate the agreement.

14. 14. Evidential agreement

In disputes arising from this agreement, KepHomes’ system and server records, transaction and audit logs and electronic records constitute conclusive evidence within the meaning of the Turkish Code of Civil Procedure.

This clause does not limit the evidential rights of Users qualifying as consumers under consumer legislation.

15. 15. Changes to this agreement

This agreement may be updated following changes in legislation or developments in the services. Material changes are announced on the Platform before they take effect.

Continuing to use the Platform after a change takes effect means you accept the updated text.

16. 16. Governing law and jurisdiction

This agreement is governed by Turkish law.

The Courts and Execution Offices of Antalya have jurisdiction. Users qualifying as consumers retain the right to apply to Consumer Arbitration Committees and Consumer Courts.
